Retirement villages

The Retirement Commissioner is responsible for monitoring the effects of the new legislation, administering the disputes process and approving members to the disputes panel.

The Department of Building and Housing is responsible for administering the legislation and providing information to operators, residents and intending residents.

Proposed variations to the Code of Practice 2008

Under the Retirement Villages Act 2003 the Retirement Commissioner is responsible for holding a consultation process on any proposed variations to the Code of Practice 2008.

The Commissioner can then make recommendations to the Minister for Building and Construction on those variations.

The Retirement Commissioner is currently considering submissions received on proposed variations which concern no-fault exit situations in Retirement Villages such as that which occurred as a result of the Canterbury Earthquakes.

The Department of Building and Housing prepared a discussion document with their set of proposed variations to the Code of Practice and are now considering submissions.  Submissions closed on 21 November 2011.
