Retirement Villages (Disputes Panel) Regulations 2006

The Disputes Panel Regulations contain details of the process for resolving disputes between residents and operators or between residents. From 1 October 2006 all retirement villages, as defined in section 6 of the Act, need to operate an internal complaints facility. Any disputes that cannot be resolved at the village level can then be resolved by an independent Disputes Panel by giving a dispute notice.

Retirement Villages (General) Regulations 2006

The General Regulations provide detail on:

  • The content of the documents necessary to register a village and to file annual returns, including forms
  • Requirements for informing the Registrar of changes to the village
  • The content of disclosure statements
  • The content of occupation right agreements
  • The form of the certificate for the lawyer advising an intending resident
  • The powers and duties of statutory supervisors of villages to be set out in the deed of supervision between the statutory supervisor and the operator, and the criteria for exemption.

The General Regulations came into force on 1 May 2007.

Retirement Villages (Fees) Regulations 2006

The Fees Regulations set out the fees payable for the registration of villages and for the filing of annual returns and other matters. The initial registration fees are:

  • $540 for villages with up to 34 residential units
  • $1,700 for villages with 35 to 84 units
  • $4,410 for villages with more than 85 units.

The registration of villages takes place over a 12-month period from 1 May 2007 onwards.
